Interim administration in the name of non-party caretaker government was introduced in Bangladesh first time in 1991 for one term. Afterwards in 1996, the system was introduced permanently in the country's constitution. The objective of introducing such system was to conduct free and fair national polls of the parliament under a neutral interim administration. The caretaker government conducted last three consecutive national elections in 1991, 1996 and 2001. Each time, the loosing side claimed there was rigging in conducting the polls. It could be recalled that Bangladesh Nationalist Party (BNP) won in the polls in 1991 (singly) and 2001 (along with their Islamist allies), while Bangladesh Awami League (AL) won in 1996 polls. These are the two mainstream political forces of the country, and it is expected that either of them (either singly or with their allies) will be the main contenders for the state power in the days to come as well. However, it is clear whoever is defeated, they claim rigging occurred in the polls as the AL claimed in 1991 and 2001, while BNP did in 1996. That has become a big debate. This is in one side.
On the other hand, in context of reality, if everything goes in the right direction that BNP and its allies would be in power till their legitimate period, that the next parliamentary polls will be held some times might be in late 2006 or early 2007, and who will be then appointed as the non-party caretaker government to conduct the polls. It is not much difficult to analyze. It could be done one by one. First, there are three main pillars of the caretaker government; they are (1) the President, (2) the Chief Adviser (CA) and (3) the Chief Election Commissioner (CEC) of the country. One by one, who is where and who will be where to hold these three important positions, it could be pointed out easily as done hereunder along with their roles, specifically in terms their neutrality.
Firstly, the present president Professor Dr. Iajuddin Ahmed will be in his position, there is no doubt, since he is most loyal to the BNP high commands, as such he will not have the fate of his predecessor Professor Dr. AQM Badruddoza Chowdhury. Dr. Ahmed is a hardcore and veteran BNP follower and was choice of BNP to the caretaker government advisory body in 1991 to represent them. Also he was the founding leader of Zia Parishad (an organization formed by BNP hardcore intellectuals in the name late Ziaur Rahman, an ex president of the country and who was the founder of BNP). As such, there is every reason that Dr. Ahmed would not be a neutral person to guide the next caretaker government; rather he would be sided to BNP and its allies to favor.
Secondly, the position of Chief Adviser, who will be there? Constitutionally, the first choice for this position is the immediate past Chief Justice (CJ) of the Supreme Court. On this issue, it is now clear that the next Care-Taker Govt. would be headed by the last retired Chief Justice of Bangladesh Justice K.M. Hasan. The burning question is whether it is at all possible to hold a peaceful, fair and impartial election by a Caretaker Govt. headed by Justice K. M. Hasan. It is widely known that at one time Justice Hasan was the International Affairs Secretary of BNP. During eighties, he was re-warded by late President Ziaur Rahman by posting him as Ambassador of Bangladesh to Iraq . As a Judge in the High Court Division, he expressed embarrassed to hear the Appeal case of murder case of Sheikh Mujib. The reason for such embarrassment has been learnt to be that one of the convicted accused is his nearest relation. Being an active member of a political party, strong allegiance to that party, serving as an Ambassador on political appointment and close relation of one of the killers of the Father of the Nation, his case for elevation from High Court Division to the Appellate Division was not considered during the period of Awami League Govt. However, when the Alliance Govt. came to power in 2001, Justice Hasan was again re-warded not only by elevating him to the Appellate Division, but he was also appointed as the Chief Justice of Bangladesh. As such it is expected that he would try his level best to payback to his rewardants, otherwise he would be simply a betrayer.
Thirdly, the present CEC Mr. M. A. Syed seems to be guided and overruled by the present allies of government. Also it was observed apparently that Mr. Syed who has been holding this position since May 2000 failed to discharge his responsibilities being unbiased during the last national polls in October 2001. Now, there could be two options for the CEC position to take care of. Option one is that the present CEC retains, as he is faithful, loyal and can be overruled by the present government party(s) and option two is that the present government can oust him and appoint a new CEC some time within their tenure, who will be their party man as the other two (the President & the CJ – expected to be the Chief Adviser).
On the other hand the present 4-party government has already started their electoral engineering process through posting their likeminded people in each and every corner of the important place of control starting from admin, police, armed forces, paramilitary, election commission, media and local government bodies. The BNP-Jamat minded caretaker government would not remove or replace the posting for their self-interest. They are building a huge vote bank of under-age voters who will caste their votes more than once in favor of the islamist alliance as was done at bye-election of constituency number 10 in the Dhaka City on July 02, 2004 .
In these circumstances, what is the percent of chance that the next interim government of Bangladesh will be a NON-PARTY CARE TAKER one in true sense to conduct free and fair parliamentary polls? Answer is simple and it is 0. Because the genesis and synthesis hereinabove shows that the men of the present ruling parties will hold all of the main three pillars, and they are proven to be completely non-neutral.
As told earlier that all three previous elections under the non-party caretaker government allegedly were not free and fair according to the defeated parties of the either side. There were some facts and truths behind each allegation. Also there will be facts and truths in the upcoming polls in late 2006 or early 2007 for the reasons understandable.
In addition to the generalized statement hereinabove, Bangladesh suffers a great debacle possessing subversive factors of non-secular state character, and the society with full of terrorism and crimes to the highest forms of exposure. And unfortunately, the activists of parties representing the present government are the majority in doing such heinous jobs. These are the activists that the party high commands cannot control or do not want to control for their political ideology and belief. If the party high commands cannot control their extremist followers, how & why an interim government, who is also to be consisted of the followers of same party high commands, will control them? It is evident that there is no reason to do so. Thus, the situation would be bound to be worst in order to conduct a free and fair election to come.
Now, how to ensure comparatively free and fair elections in the days to come in order to establish fruitful democracy in Bangladesh ? Ways and means have to be figured out. There is nothing constant in the physical world, more specifically the rules and laws made by the human beings for governing themselves. Thousands of burning examples are available in the world books of history. Just to look into Bangladesh perspective, how many times the constitution of this country has been amended? 16 times. Why? Because of expecting good governance and better society and lifestyle as it is explained each time while doing such changes. What the achievement is that could be a different question. But those happened, and the inclusion of “NON-PARTY CARE TAKER GOVERNMENT” in the county's constitution through its 13 th amendment is a major one. So, amendment is always claimed positive by its movers and executers, it is evident.
Now, it cannot be expected that the present ruling parties of Bangladesh will agree for such amendment in the constitution, because this is a direct move against their political interest. So, what to do?
Yes, there are ways and means. It is observed that the world communities come forward to face insurgents and other special issues wherever and whenever required. Not going far behind, in the present days, the missions of world community are working for various reasons for the betterment of the mankind such as in Bosnia & Herzegovina, Sierra Leone, Iraq, Afghanistan, Somalia, Ethiopia, Mali, Angola, Chile , Costa Rica, Honduras, Chad, Sudan and many more countries and places of the world. One specific case is that the world communities also take parts in the national polls of most of the worlds in different forms as per case-to-case basis needs of which the most common one is the “Observation Team”.
In Bangladesh perspective, the United Nations (UN) is the most proper authority to play vital roles with an expert supervisory team to monitor the functions of the interim government of the country during national polls. The form and terms and references of such UN Team could be defined with agreed consents of all relevant groups and parties of interest.
The people of Bangladesh deserve such a great initiative by the world's top most prestigious and impartial organization, the UN. They deserve help from UN, because of establishment of real democratic state that will be free from all kinds of terrorism, religious fanaticism & extremism and corruption.
Bangladesh shouts such help, because the situation here is the most vulnerable and grievous in terms of placing partisans in democratic institutions and constitutional positions, broken down law and order situation, corruption and religious intolerance.
The country is in the verge of big question whether it will be terrorism & corruption free secular, liberal, democratic and progressive one or whether these will take over holding 140 million to make a nation of hostages.
Therefore, this is the time that UN apprehends and prevents this deltaic country from being an Afghanistan or Iraq or else.
The proposed UN supervisory should be permanent body that could be an instance and work for any like-wise country deserving such help to establish democracy, may be with changed terms & conditions. |
